These can involve the validity of the notarized contract (e.g. questions concerning the existence of side agreements that require notarization) or the effective submission of party declarations in connection with the implementation of the contract (valid delivery of declarations made by a party, due date notifications, etc.).

Another area that often leads to litigation following (real estate) transactions is contractual guarantees and indemnities. Disputes are especially likely when these are combined with contractual purchase price retentions and escrows. And finally, in connection with disputes following (real estate) transactions, questions of advisor’s liability (attorney, tax advisor and notary liability) can arise.
